END-USER LICENSE AGREEMENT FOR AnswersThatWork.com SOFTWARE
1 - What you should definitely know before you install !
You are about to install The Ultimate Troubleshooter from AnswersThatWork.com. Amongst other things The Ultimate Troubleshooter enables you, the end-user, to modify certain configuration settings in Windows. We use this software ourselves on a daily basis with absolute and total confidence. That said, as with any other software, if you are currently experiencing extremely serious problems with your PC, the installation of our software could run into problems, not because of problems with our software, but because of problems with your PC. As a direct result the installation of any software, whether our software or someone else's software, could turn your existing problems into worse problems, if not terminal problems. Since we do not know the current condition and make up of your PC and since, crucially, we are not performing this installation ourselves, We, AnswersThatWork.com, will not be responsible for any direct or indirect damage to your computer(s), direct or indirect physical damage to yourself, other people, or things, sustained as a result of installing and using our software at any time in the life of your computer. In other words, if you want to be able to hold someone fully accountable and responsible for anything that might arise in the process of using and installing our software, call in an expert, a consultant, and have them come in and install and use our software on your behalf.
1a - Another thing you should definitely know before you install !
This software is protected against unauthorized use or duplication. The means of protection is through a Serial Number which we send you once you purchase the software. This Serial Number is for your own use only and should not be disseminated and distributed. As with most serial numbers in our industry, whether they be software or hardware (printers, monitors, etc...) serial number, our serial numbers enable us to track the licence directly to You. Should we find your serial number posted on the Internet for others to use, we will disable your licence for The Ultimate Troubleshooter in all future versions of our product and in most cases we will not re-issue you, the original licensee, with a replacement number - you will need to re-purchase The Ultimate Troubleshooter to be able to use future versions of our product.
2 - This License Agreement
This AnswersThatWork.com End-User License Agreement ("EULA") is a legal agreement between you (either an individual or a single entity) and AnswersThatWork.com for the AnswersThatWork.com software product The Ultimate Troubleshooter , which includes computer software and may include associated media, printed materials, and "online" or electronic documentation ("SOFTWARE PRODUCT"). The SOFTWARE PRODUCT also includes any updates and supplements to the original SOFTWARE PRODUCT provided to you by AnswersThatWork.com. By installing, copying, downloading, accessing or otherwise using the SOFTWARE PRODUCT, you agree to be bound by the terms of this EULA. If you do not agree to the terms of this EULA, do not install or use the SOFTWARE PRODUCT.
3 - Your Rights (what we allow you to do)
The SOFTWARE PRODUCT is protected by copyright laws and international copyright treaties, as well as other intellectual property laws and treaties. The SOFTWARE PRODUCT is licensed to you, not sold.
GRANT OF LICENSE. This EULA grants you the following rights :
Usage of the Software (Licensing). As a general rule you may install, use, access, display, run, or otherwise interact with ("RUN") one copy of the SOFTWARE PRODUCT on a single computer only. The following variations apply, however :
l Home Users : Home Users may use one licence to cover one desktop PC in their home and one laptop. In any other scenario, e.g. two desktop PCs, or two laptops, a licence must be purchased for each computer.
l Business Users : Each computer must be covered by its own individual licence for the SOFTWARE PRODUCT.
Storage on a Network. You may store or install a copy of the SOFTWARE PRODUCT on a storage device, such as a network server, used only to RUN the SOFTWARE PRODUCT on your other COMPUTERS over an internal network. However, you must purchase a license for each separate COMPUTER on which the SOFTWARE PRODUCT is RUN or INSTALLED from the storage device. A license for the SOFTWARE PRODUCT may never be shared or used concurrently on different COMPUTERS except for the scenario mentioned above in "Usage of the Software".
Corporate & Multiple Licenses. If this software is part of a Multiple Licenses purchase, or is part of a Corporate License , you may run additional copies of the SOFTWARE PRODUCT up to the number of copies purchased. You are also entitled to make a corresponding number of secondary copies for portable computer use as specified above in "Usage of the Software".
Reservation of Rights. All rights not expressly granted are reserved by AnswersThatWork.com.
4 - The Limitations, Our Rights, and Other Rights
Reverse Engineering, Decompilation, and Disassembly. You may not reverse engineer, decompile, or disassemble the SOFTWARE PRODUCT.
Separation of Components. The SOFTWARE PRODUCT is licensed as a single product. Its component parts may not be separated for use on one or more than one COMPUTER.
Trademarks. This EULA does not grant you any rights in connection with any trademarks or service marks of AnswersThatWork.com.
Rental. You may not rent, lease, or lend the SOFTWARE PRODUCT.
Support Services. AnswersThatWork.com may provide you with support services related to the SOFTWARE PRODUCT ("Support Services"). Use of Support Services is governed by the AnswersThatWork.com policies and programs described in the user manual, in the software's in-product Help, in "online" documentation, and/or in other AnswersThatWork.com provided materials. Any supplemental software code provided to you as part of the Support Services shall be considered part of the SOFTWARE PRODUCT and subject to the terms and conditions of this EULA. With respect to technical information you provide to AnswersThatWork.com as part of the Support Services, AnswersThatWork.com may use such information for its business purposes, including for product support and development. AnswersThatWork.com will not utilize such technical information in a form that personally identifies you.
Software Transfer. The initial licensee of the software may not make a permanent transfer of this EULA and SOFTWARE PRODUCT to another end user, company, or organization without our written consent. We reserve the right to refuse such consent without explanation.
Termination. Without prejudice to any other rights, AnswersThatWork.com may terminate this EULA if you fail to comply with the terms and conditions of this EULA. In such event, you must destroy all copies of the SOFTWARE PRODUCT and all of its component parts.
5 - Copyright
All title and copyrights in and to the SOFTWARE PRODUCT (including but not limited to icons, text, Tasks and Services and Startups descriptions and recommendations text, video, audio and "applets" incorporated into the SOFTWARE PRODUCT), the accompanying printed materials, and any copies of the SOFTWARE PRODUCT are owned by AnswersThatWork.com or its suppliers. All title and intellectual property rights in and to the content which may be accessed through The Ultimate Troubleshooter is the property of the respective content owner and may be protected by applicable copyright or other intellectual property laws and treaties. All quoted text contained within The Ultimate Troubleshooter is the copyright and property of the quoted website or software publisher. This EULA grants you no rights to use such content. If this SOFTWARE PRODUCT contains documentation which is provided in electronic form, you may print such electronic documentation.
6 - Export Restrictions
Although The Ultimate Troubleshooter originates in the United Kingdom, part of this SOFTWARE PRODUCT was written using Microsoft development products. Since Microsoft is a US company, the export restrictions which apply to software products originated in the US also apply to this software. Therefore the following terms apply: You agree that you will not export or re export the SOFTWARE PRODUCT, any part thereof, or any process or service that is the direct product of the SOFTWARE PRODUCT to any country, person or entity subject to U.S. export restrictions. You specifically agree not to export or re-export any of the SOFTWARE PRODUCT or services built around the SOFTWARE PRODUCT (a) to any country to which the U.S. has embargoed or restricted the export of goods or services, which currently include, but are not necessarily limited to Cuba, Iran, Iraq, Libya, North Korea, Sudan and Syria, or to any person, company, or organization, wherever located, who intends to transmit or transport the SOFTWARE PRODUCT back to such country; (b) to any person or entity who you know or have reason to know will utilize the SOFTWARE PRODUCT in the design, development or production of nuclear, chemical or biological weapons; or (c) to any person or entity who has been prohibited from participating in U.S. export transactions by any federal agency of the U.S. government. You warrant and represent that neither the BXA nor any other U.S. federal agency has suspended, revoked or denied your export privileges.
7 - Miscellaneous
If you acquired this SOFTWARE PRODUCT in the United States, this EULA is governed by the laws of the State of Florida.
If you acquired this SOFTWARE PRODUCT in Australia or Canada, unless expressly prohibited by local law, this EULA is governed by the laws in force in your state of residence.
If this SOFTWARE PRODUCT was acquired outside the United States, Canada, or Australia, then local law may apply.
8 - Warranty Issues
AnswersThatWork.com warrants that the SOFTWARE PRODUCT will perform substantially in accordance with the accompanying written materials or, in absence of such materials, with the product's description on the AnswersThatWork.com website, for a period of ninety (90) days from the date of purchase, and that Support Services provided by AnswersThatWork.com shall be substantially as described in applicable written or electronic materials provided to you by AnswersThatWork.com, and that AnswersThatWork.com support engineers will make commercially reasonable efforts to solve any problem issues. Some countries or states within countries, and jurisdictions, do not allow limitations on duration of an implied warranty, so the above limitation may not apply to you. To the extent allowed by applicable law, implied warranties on the SOFTWARE PRODUCT, if any, are limited to ninety (90) days.
9 - Liabilities
AnswersThatWork.com's, its suppliers', and its resellers' entire liability and your exclusive remedy shall be, at AnswersThatWork.com's option, the return of the price paid. This Limited Warranty is void if failure of the SOFTWARE PRODUCT has resulted from accident, abuse, or misapplication. Any replacement SOFTWARE PRODUCT will be warranted for the remainder of the original warranty period or 30 days, whichever is longer. At all times these remedies are subject to available proof of purchase.
10 - No Other Warranties
To the maximum extent permitted by applicable law, AnswersThatWork.com and its suppliers and resellers disclaim all other warranties and conditions, either express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement, with regard to the SOFTWARE PRODUCT, and the provision of or failure to provide Support Services. This limited warranty gives you specific legal rights. You may have others, which vary from country to country, or from state of a country to another state of that country.
11 - Overall Limitation of Liability
To the maximum extent permitted by applicable law, in no event shall AnswersThatWork.com or its suppliers and resellers be liable for any special, incidental, indirect, or consequential damages whatsoever (including, without limitation, physical damage to goods and people, damages for loss of business profits, business interruption, loss of business information, or any other pecuniary loss) arising out of the use of or inability to use the SOFTWARE PRODUCT or the provision of or failure to provide Support Services, even if AnswersThatWork.com has been advised of the possibility of such damages. In any case, AnswersThatWork.com's entire liability under any provision of this EULA shall be limited to the greater of the amount actually paid by you for the SOFTWARE PRODUCT or U.S.$40 (forty US dollars); provided, however, if you have entered into an AnswersThatWork.com Support Services Agreement, AnswersThatWork.com's entire liability regarding Support Services shall be governed by the terms of that agreement. Because some countries, or states within countries, do not allow the exclusion or limitation of liability, the above limitation may not apply to you.
