License Agreement
This License Agreement is a legal Agreement between you, as an individual or an organisation and Bernd-U. Vormbaum, EDV Beratung & Vertrieb. Please read this Agreement carefully.
1. Subject.
The subject of the present Agreement is the delivered software package hereinafter mentioned as Software including the whole delivery package, namely software itself and the covering documentation.
2. Copyright.
This Software is owned by Bernd-U. Vormbaum, EDV Beratung&Vertrieb and is protected by international copyright laws and treaties. Any changes to the Software and its components, any additions to it as well as storage and distribution of such a changed or augmented Software, are strictly prohibited.
3. License grant
Bernd-U. Vormbaum, EDV Beratung & Vertrieb grants Customer a worldwide, non-exclusive license to use the software on any one computer. Customer may not network the software or otherwise use it on more than one computer. Customer may make copies or adaptations of the software (a) for archival purposes or (b) when copying or adaptation is an essential step in the use of the software with a computer so long as the copies and adaptations are used in no other manner
4. General terms for the software
a) Software is owned and copyrighted by Bernd-U. Vormbaum, EDV Beratung & Vertrieb. Customer's license to use the Software confers no title
or ownership and is not a sale of any rights in the Software.
b) Customer has no right to rent, lease, time share, or otherwise transfer the rights to the Software without the written consent of the owner of the
Software. Customer may not copy the Software onto any public or distributed network.
c) Customer must reproduce all copyright notices and other proprietary legends in or on the original Software on all permitted copies or adaptations.
d) You may not remove from the Software, or alter, any of the trademarks, trade names, logos, patent or copyright notices or markings, or add any
other notices or markings to the Software.
e) Customer will not modify, disassemble, decompile, decrypt, or otherwise attempt to access or determine the source code of the Software
f) The Software may be only compatible with certain hardware platforms and/or operating systems. Customer acknowledges and agrees that customer
has the sole responsibility to independently obtain and independently license and/or acquire the system requirements.
5. Accepting or rejecting the agreement.
Any usage of this product including installation of the Software or any of its parts on a computer, loading the product into operating memory (RAM) or permanent storage on a computer's disk or other storage medium, as well as any other type of usage means that you accept all the terms and conditions of the present agreement. If you do not agree with any statement of this License, you should promptly terminate usage of the product and delete all the files referred to it, as its components, so as the results of its work, from your computer. You should also return all the existing mediums containing the Software to the place where you obtained it.
6. Warranty and guarantee.
To the extent allowed by local law, this software is provided to you “as is†without warranties or conditions of any kind, whether oral or written, express or implied. Bernd-U. Vormbaum, EDV Beratung und Vertrieb specifically disclaims any implied warranties or conditions of merchantability, satisfactory quality, non-infringement, title, accuracy of informational content, and fitness for a particular purpose. The entire risk as to the results and performance of the software is assumed by you. no oral or written information or advice given by Bernd-U. Vormbaum, EDV Beratung und Vertrieb or Bernd-U. Vormbaum, EDV Beratung und Vertrieb’s authorized representatives shall create a warranty or amend this “as is†warranty. Some jurisdictions do not allow exclusions of implied warranties or conditions, so the above exclusion may not apply to you to the extent prohibited by such local laws. You may have other rights that vary from country to country, state to state, or province to province. |
