End user agreement for Rebel Strip Poker
END-USER LICENSE AGREEMENT FOR REBEL STRIP POKER™
IMPORTANT-READ CAREFULLY: This Rebel Software End-User License Agreement ("EULA") is a legal agreement between you (either an individual or a single entity) and Rebel Software for the software applications collectively known as Rebel Strip Poker. This agreement covers the computer software and any associated media, printed materials, and "online" or electronic documentation (known as the "SOFTWARE PRODUCT" in the remainder of this agreement).
The SOFTWARE PRODUCT also includes any updates and supplements to the original SOFTWARE PRODUCT provided to you by Rebel Software. By installing, copying, downloading, accessing or otherwise using the SOFTWARE PRODUCT, you agree to be bound by the terms of this EULA. If you do not agree to the terms of this EULA, do not install, copy, or otherwise use the SOFTWARE PRODUCT.
SOFTWARE PRODUCT LICENSE
The SOFTWARE PRODUCT is protected by copyright laws and international copyright treaties, as well as other intellectual property laws and treaties. The SOFTWARE PRODUCT is licensed, not sold.
1. GRANT OF LICENSE. This EULA grants you the following rights:
1.1 License Grant. You may install and use one copy of the SOFTWARE PRODUCT on a single computer. You may also store or install a copy of the SOFTWARE PRODUCT on a storage device, such as a network server, used only to install or run the SOFTWARE PRODUCT over an internal network; however, you must acquire and dedicate a license for each separate computer on or from which the SOFTWARE PRODUCT is installed, used, accessed, displayed or run. A license for the SOFTWARE PRODUCT may not be shared or used concurrently on different computers.
1.2 Multiple Licenses. If you have multiple licenses for the SOFTWARE PRODUCT, then at any time you may have as many copies of the SOFTWARE PRODUCT in use as you have licenses. The About screen of the software will indicate the number of licenses of the SOFTWARE PRODUCT purchased for your location.
1.3 Travel Use. You may install the software for educational use (for example, one instance of a class) on a computer not at your facility for a short period provided that the software is completely uninstalled when this period is over. However, the simultaneous number of copies of the software "in use" is not to exceed the number of licenses you have purchased. In other words, if you have licensed 3 copies of the software, and you have 2 copies of the software "in use" at your facility, you are granted the right to use 1 copy of the software for a short period of time at another location for educational use. This software must be completely removed when this period is over.
2. DESCRIPTION OF OTHER RIGHTS AND LIMITATIONS.
Limitations on Reverse Engineering, Decompilation, and Disassembly. You may not reverse engineer, decompile, or disassemble the SOFTWARE PRODUCT, except and only to the extent that such activity is expressly permitted by applicable law notwithstanding this limitation.
Rental. You may not rent, lease or lend the SOFTWARE PRODUCT.
Trademarks. This EULA does not grant you any rights in connection with any trademarks or service marks of Rebel Software.
Termination. Without prejudice to any other rights, Rebel Software may terminate this EULA if you fail to comply with the terms and conditions of this EULA. In such event, you must destroy all copies of the SOFTWARE PRODUCT and all of its component parts.
3. UPGRADES. If the SOFTWARE PRODUCT is labeled as an upgrade to a previous version of Rebel Strip Poker, you must be properly licensed to use a product identified by Rebel Software as being eligible for the upgrade in order to use the SOFTWARE PRODUCT. A SOFTWARE PRODUCT labeled as an upgrade replaces and/or supplements the product that formed the basis for your eligibility for the upgrade. You may use the resulting upgraded product only in accordance with the terms of this EULA.
4. COPYRIGHT. All title and intellectual property rights in and to the SOFTWARE PRODUCT (including but not limited to any images, photographs, animations, video, audio, music, and text incorporated into the SOFTWARE PRODUCT), the accompanying printed materials, and any copies of the SOFTWARE PRODUCT are owned by Rebel Software. All title and intellectual property rights in and to the content which may be accessed through use of the SOFTWARE PRODUCT is the property of the respective content owner and may be protected by applicable copyright or other intellectual property laws and treaties. This EULA grants you no rights to use such content. All rights not expressly granted are reserved by Rebel Software.

THIS SOFTWARE AND ACCOMPANYING WRITTEN MATERIALS (INCLUDING INSTRUCTIONS FOR USE) ARE PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND. Further, Rebel Software does not warrant, guarantee, or make any representations regarding the use, or the results of use, of the software or written materials in terms of correctness, accuracy, reliability, currentness, or otherwise. The entire risk as to the results and performance of the software is assumed by you. If the software or written materials are defective you, and not Rebel Software (including its dealers, distributors, agents, and employees), assume the entire cost of all necessary servicing, repair, or correction.
The above is the only warranty of any kind, either express or implied, including but not limited to the implied warranties of merchantability and fitness for a particular purpose, that is made by Rebel Software, on this Rebel Software product. No oral or written information or advice given by Rebel Software, its dealers, distributors, agents or employees shall create a warranty or in any way increase the scope of this warranty and you may not rely on any such information or advice. You may have other rights which vary from state to state.
CUSTOMER REMEDIES. Rebel Software's entire liability and your exclusive remedy shall be return of the price paid for the SOFTWARE PRODUCT, if returned within 30 days of payment of the license for use. This Limited Warranty is void if failure of the SOFTWARE PRODUCT has resulted from accident, abuse, or misapplication.
NEITHER REBEL SOFTWARE NOR ANYONE ELSE WHO HAS BEEN INVOLVED IN THE CREATION, PRODUCTION OR DELIVERY OF THIS PRODUCT SHALL BE LIABLE FOR ANY DIRECT, INDIRECT, CONSEQUENTIAL OR INCIDENTAL DAMAGES (INCLUDING DAMAGES FOR LOSS OF BUSINESS PROFITS, BUSINESS INTERRUPTION, LOSS OF BUSINESS INFORMATION, AND THE LIKE) ARISING OUT OF THE USE OR INABILITY TO USE SUCH PRODUCT EVEN IF REBEL SOFTWARE HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
This limited warranty shall be governed in accordance with the laws of the State of South Australia
By using the shareware version of Rebel Strip Poker you agree that you have read this document, understand it, and agree to be bound by its' terms and conditions. You also agree that the Limited Warranty is the complete and exclusive statement of agreement between the parties and supersedes all proposals or prior agreements, oral or written, and any other communications between the parties relating to the subject matter of the Limited Warranty.
